These Terms and Conditions ("Terms") apply to the 2025 Code & Create Fellowship ("Fellowship") sponsored by R29, LLC ("Refinery29"), in partnership with Computer Science is Everything ("Computer Science is Everything").

  1. ELIGIBILITY. The Fellowship is open solely to legal residents of the fifty (50) United States and the District of Columbia, who are at least eighteen (18) years of age and are actively enrolled high school students at the time of entry. Entrants that fail to meet the foregoing criteria are not eligible for consideration and are not authorized to participate in the Fellowship. Entrants must have either a valid social security number or a valid U.S. personal tax identification number to participate. Employees, officers, and directors of Refinery29, Computer Science is Everything, or any their respective parent companies, subsidiaries, affiliates, partners, advertising or promotion agencies, manufacturers or distributors of promotion materials, or any of their immediate families (parents, children, siblings, spouse) or members of the same household (whether or not related) of such employees, officers, and directors are not eligible to enter. The Fellowship is subject to and governed by all applicable federal, state, and local laws and regulations of the United States and is void where prohibited. Participation in the Fellowship (i.e., submission of an entry) constitutes an entrant's full and unconditional agreement to these Terms and Refinery29's decisions with respect to all matters relating to the Fellowship, which decisions shall be deemed final and binding. No purchase or payment of any kind is necessary to enter or win. A purchase or payment of any kind will not increase your chances of winning.

  2. ENTRY PERIOD. The Fellowship begins at 12:00:00 p.m. EDT on March 31, 2025, and ends at 11:59:59 a.m. EDT on April 20, 2025 (the "Entry Period"). Refinery29's computer is the official time keeping device for purposes of the Entry Period.

  3. HOW TO ENTER. During the Entry Period, enter the Fellowship by completing and submitting the online application form available at https://www.refinery29.com/en-us/codeandcreate (the "Submission Form"). Apart from the Submission Form, no other method of entry will be accepted. Only the first one hundred (100) eligible submissions will be considered.

  4. All entries must be received during the Entry Period and must comply with these Terms. The maximum number of entries allowed during the Entry Period is one (1) per entrant. Eligible entrants must have an email address to enter. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations or logins, or any other methods will void that entrant's entries, and that entrant will be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any email address, the authorized account holder of the email address used to enter the Fellowship will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder. If entering with a mobile phone or other web-enabled device and using your wireless carrier's network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. Entries will not be acknowledged or returned. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Refinery29. No entry may contain any offensive or vulgar content. Any entry containing inappropriate content, as determined by Refinery29, in its sole and absolute discretion, will be considered ineligible and will not be considered for the Fellowship. By participating in the Fellowship, you acknowledge and agree to be bound by these Terms, Refinery29's privacy policy (available at https://web-statics-cdn.refinery29.com/privacy-policy/docs/us/privacy-policy.html), and any other relevant rules, policies or regulations.

  5. REQUIREMENTS OF ENTRIES. By entering the Fellowship, each entrant represents and warrants that: (a) the entrant's entry does not contain any material or elements that are not owned by the entrant, or which are subject to the rights of third parties; (b) entrant's entry is not a duplicate of any other submitted entries; (c) entrant's entry will not violate any law, rule or regulation or infringe on any rights of any third parties; and (d) the entry complies with Refinery29's Terms of Use (available at https://web-statics-cdn.refinery29.com/privacy-policy/docs/us/terms-of-use.html). By submitting an entry, entrants agree that Refinery29, in its sole discretion, may remove any entry and disqualify an entrant from the Fellowship if it believes, in its sole discretion, that the entrant's entry fails to conform to the foregoing or these Terms. By entering the Fellowship, entrants agree that Refinery29's decisions are final and binding in all matters relating to the Fellowship, including, but not limited to, interpretation and application of these Terms. By entering the Fellowship, entrants fully and unconditionally agree to be bound by these Terms and the decisions of Refinery29. By submitting an entry, entrants hereby grant, without obligation, permission for the entry to be posted on Refinery29's owned, operated and/or affiliated websites, applications, and/or social media platforms (as well as those of Computer Science is Everything). Entrants agree that the Released Parties (as defined below) are not responsible for any unauthorized use of entries by third parties. The Released Parties do not guarantee the posting of any entry.

  6. PRIZE. Two (2) winners will each receive the following prize: Five Hundred Dollars ($500.00 USD) and the opportunity to work with Refinery29's editorial team to author one (1) custom article (600-800 words, relating to coding or computer science) in partnership with Computer Science is Everything to be published on Refinery29.com, with organic promotion by Refinery29 and Computer Science is Everything on their respective owned and operated digital channels. The total approximate value of all prizes is One Thousand Dollars ($1,000.00 USD).

    Prizes are non-transferable and no substitutions or other redemptions are permitted, unless otherwise agreed by Refinery29. In the case of unavailability of any prize, Refinery29 reserves the right to substitute the prize with another prize of equal or greater value. All unspecified expenses are the responsibility of the respective winner. Limit one (1) prize per person or household. The prize is awarded "as-is" with no warranty or guarantee, either express or implied. The winner is responsible for all applicable federal, state, and local taxes, if any, as well as any other costs and expenses associated with acceptance and/or use of their prize that are not specified herein as being provided. Where applicable, taxes may be withheld by Refinery29 and Refinery29 shall have no obligation to adjust the prize or otherwise compensate the winner for any taxes withheld. The winner agrees to furnish Refinery29 with and/or execute any additional document requested by Refinery29 in connection with the awarding of their prize.

  7. HOW WINNERS ARE DETERMINED. Entries will be reviewed by members of a committee consisting of an internal panel of Refinery29 editors (the "Committee"). The winners will be selected from among all eligible entries based on the following criteria.

    1. Creativity and Innovation (25%): How creatively and innovatively has the entrant applied computer science skills to real-world or personal projects? Does their work demonstrate originality?

    2. Passion and Clarity (25%): How clearly does the entrant connect their computer science skills to their passion or hobby? Does the application effectively showcase the alignment between their skills and interests?

    3. Submission Quality and Fellowship Alignment (25%): How strong is the overall quality of the submission? Does it reflect attention to detail, originality, and alignment with the Fellowship's goals of fostering creativity and advancing computer science skills?

    4. Audience (25%): How will the applicant's work and perspective resonate with Refinery29's audience? Does it align with the interests and values often represented in Refinery29's content, and does it have the potential to engage and inspire the audience?

    In the event of a tie, the Committee will select the entrant that has the higher score under the "Creativity and Innovation" category. For the avoidance of doubt, neither Refinery29 nor the Committee are under any obligation to reveal the degree of consideration it may have given to any entry, including, but not limited to, stating any reason for rejection, or to return any entry materials to any entrant.

  8. WINNER NOTIFICATION. Subject to verification of eligibility and compliance with these Terms, the entrants that entered the winning entries chosen, as determined by the Committee, will be deemed the winners. The Committee will notify winners by email on or about May 5, 2025. Winners must respond to Refinery29's notification within forty-eight (48) hours after the date of notification. A winner's failure to respond to the prize notification within the specified forty-eight (48) hour period will be considered such winner's forfeiture of the prize and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries. After initial contact has been made, subsequent communication may take place via email or telephone. Winners may be required to sign and return, where legal, an Affidavit/Declaration of Eligibility, Liability/Publicity Release and/or rights transfer document within forty-eight (48) hours of receipt. If such document is not returned within the specified time period, or a prize or prize notification is returned as undeliverable, or a winner is not in compliance with these Terms, that winner's prize will be forfeited, and an alternate winner may be selected. Upon prize forfeiture, no compensation will be given. In the event of a dispute as to the identity of any winner, Refinery29 reserves the right in its sole discretion to select another winner and the unidentifiable winner will forfeit all rights to a prize. Refinery29 is not responsible for suspended or discontinued Internet, wireless, or land-line phone service or a change in an entrant's email, phone number or mailing address which may result in a winner not receiving the initial prize notification or their prize information.

  9. LIMITATION OF LIABILITY & RELEASE. Refinery29, Computer Science is Everything, and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, shareholders, officers and directors (collectively the "Released Parties") are not responsible for lost, late, misdirected, unintelligible, returned or undelivered entries, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of the Fellowship, or act in violation of these Terms, or act in any manner to threaten or abuse or harass any person, as solely determined by Refinery29, will be disqualified. Released Parties are not responsible for any incorrect or inaccurate information whether caused by users, tampering, hacking, or by any of the programming or equipment associated with or used in the Fellowship, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access. Any use of robotic, macro, automatic, programmed or like entry methods will void all such entries, and may subject that entrant to disqualification. Released Parties are not responsible for injury or damage to entrants' or any other person's computer or property related to or resulting from participating in the Fellowship. Should any portion of the Fellowship be, in the Refinery29's sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Refinery29, corrupt or impair administration, security, fairness or proper play of the Fellowship, or submission of entries, Refinery29 reserves the right at its sole discretion to suspend, modify or terminate the Fellowship, and determine the winners from valid, non suspect entries received prior to action taken, or otherwise as may be deemed fair and equitable by Refinery29.

    Entrants further agree that (a) the Released Parties will have no liability whatsoever for, and are released and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons or property, or rights of publicity or privacy, defamation, copyright infringement or portrayal in a false light resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in the Fellowship or in any Fellowship related activity; and (b) each winner, by acceptance of any prize, except where legally prohibited, grants permission to Refinery29 and Computer Science is Everything (and agrees to confirm such agreement in writing upon request) and those acting pursuant to their authority to use the winner's name and/or likeness, prize information, and/or entry (and assign the entry, which may be altered, changed, modified, edited, used alone or with other works, as solely determined by Refinery29) for advertising, trade and promotional purposes without further compensation, at any time or times, in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval. Upon request by Refinery29, entrants agree to promptly execute and deliver to Refinery29 any documents reflecting the foregoing.

  10. MISCELLANEOUS. Refinery29 may seek equitable relief in any court of competent jurisdiction. If any provision of these rules is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that these rules otherwise remain in full force and effect and enforceable. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE REFINERY29'S WEBSITES OR APPLICATIONS OR UNDERMINE THE LEGITIMATE OPERATION OF THE FELLOWSHIP MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, REFINERY29 RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

  11. ARBITRATION/GOVERNING LAW. Except where prohibited by law, as a condition of participating in the Fellowship, entrants agree that (a) any and all disputes and causes of action arising out of or connected with the Fellowship, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held in the State of New York, City of New York; (b) the federal arbitration act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (c) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in the Fellowship), and entrant further waives all rights to have damages multiplied or increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

    These Terms and the interpretation of its conditions shall be governed by and construed in accordance with the laws of the State of New York without regard to the principles of conflicts of law. For any matters which are not subject to arbitration as set forth in these Terms and/or in connection with the entering of any judgment on an arbitration award in connection with these Terms and/or the Fellowship, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the county of New York in the State of New York. The parties agree not to raise the defense of forum non conveniens.

  12. USE OF DATA. Refinery29 will be collecting personal data about entrants in accordance with its privacy policy. Please review Refinery29's privacy policy (available at https://web-statics-cdn.refinery29.com/privacy-policy/docs/us/privacy-policy.html). By participating in the Fellowship, entrants hereby agree to Refinery29's collection and usage of their personal information and acknowledge that they have read and accepted Refinery29's privacy policy. If you are verified as a prize winner, your first name, last initial, city and state may be included in a publicly available winner's list.

  13. REQUEST FOR WINNERS. For the name of the winners, available within six (6) months of the end of the Entry Period, send a self-addressed, stamped, envelope to: Refinery29, Attention: Refinery29 x Computer Science is Everything Code & Create Fellowship 2025, 34 35th St., Suite 5A, Brooklyn, NY 11232. Vermont residents may omit return postage.

  14. SPONSOR. The sponsor and administrator of the Fellowship is R29, LLC, 34 35th St., Suite 5A, Brooklyn, NY 11232. The Fellowship is not administered by Computer Science is Everything. References to any third-party entity or trademark do not constitute or imply, and should not be construed as, an endorsement of the Fellowship, Refinery29, or Computer Science is Everything.
